A federal judge ruled in March 2026 that Sunnyvale violated the Clean Water Act, finding the city responsible for more than 1,200 violations involving bacteria pollution discharged from its stormwater system into Stevens Creek, Calabazas Creek, and the Sunnyvale East Channel. E. coli levels in the creeks have tested at levels 50 times higher than legal limits, posing documented public health risks. Sunnyvale was fined nearly $1.2 million — but the larger concern is the cost of remediation: a federal injunction requiring systemic infrastructure fixes could run into tens of millions of dollars. A decision on the permanent injunction is expected this summer.
