Baylands Housing vs. Wetlands — A Battle That Defines Newark's Identity

Newark is at the center of the most consequential housing vs. environment conflict in the East Bay — and it has generated active federal litigation, conservation organization opposition, and national coverage. Two major baylands developments have been proposed in what advocates call "Area 4" — the wetlands adjacent to the Don Edwards San Francisco Bay National Wildlife Refuge. The Citizens Committee to Complete the Refuge and San Francisco Baykeeper filed suit on January 9, 2026 in Alameda County Superior Court against Newark's approval of the Mowry Village project — alleging the city failed to properly account for impacts to wetlands and endangered species including the federally endangered Salt Marsh Harvest Mouse and the Western Burrowing Owl, failed to evaluate toxic pollutant risks from contaminated groundwater, and ignored sea level rise risks that could push contaminated groundwater up through the site and into adjacent wetlands. Meanwhile, Newark faces the separate Sanctuary West proposal to build 400+ "executive homes" on the heart of the Newark Area 4 baylands — two projects that together would transform habitat that conservation organizations have spent 30 years working to permanently protect.
