Los Gatos is one of the most litigated housing battlegrounds in California. The town was late in adopting a compliant Housing Element, triggering the state's "Builder's Remedy" — a mechanism that allowed developers to file projects the town could not legally block. The town could not lawfully deny the projects outright, so it attempted to redefine the rules around when applications vest — a legal strategy housing advocates characterized as inventing new procedural hurdles to slow-roll projects it didn't like. A Santa Clara County Superior Court judge dealt the town a significant legal setback in January 2026, making clear that its more restrictive interpretation of residential development rules doesn't hold up under California law. The town's RHNA mandate for the current cycle is 1,993 units — nearly triple its prior cycle requirement — and while the town has approved or is actively reviewing applications for roughly 1,776 units, multiple projects remain entangled in litigation.
